Losing a plan never locks memories on your phone. Photos above the Free allowance stay in the cloud for 90 days from the date a plan ends or is refunded, then those cloud copies may be removed.

No. Capture, Punch, make Pages and Books, browse your history and add old memories without an account. Sign in only if you want to use cloud backup and sync.
On your device. You pick which photos to use; TastePatch never scans your photo library. Photos go to cloud storage only when you turn on a Sync Journal. Signing in alone uploads nothing.
Your memories on your phone stay available. Photos above the Free allowance stay in the cloud for 90 days from when your plan ends or is refunded, so you can download them. After that, those cloud copies may be removed. Your Page details stay. Exporting a portable Archive file is free.
Yes. Turn on a Sync Journal and sign in with an account you can access on the new phone. Only Sync Journals transfer through the cloud; Journals kept only on the old phone do not sync.
